By accessing and using the CareNest website, mobile applications, or any of our healthcare services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

CareNest Health ("CareNest," "we," "our," or "us") reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any changes indicates your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

CareNest provides private nursing care, elderly care, post-surgery support, and 24/7 medical assistance. Our services are delivered by licensed and certified healthcare professionals. While we strive for the highest standards of care, our Services are not a substitute for emergency medical treatment. In case of a medical emergency, call 911 immediately.

When using our Services, you agree to the following responsibilities:

• Accurate Information: Provide truthful, accurate, and complete information during registration, booking, and care assessment processes.
• Legal Capacity: Confirm that you are at least 18 years of age or have the legal consent of a parent or guardian.
• Account Security: Maintain the confidentiality of any account credentials and notify us immediately of unauthorized use.
• Lawful Use: Use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
• Respectful Conduct: Treat our staff, nurses, and other patients with respect. Harassment, abuse, or inappropriate behavior will result in termination of services.

All content on the CareNest website, including text, graphics, logos, images, and software, is the property of CareNest or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent. The CareNest name, logo, and associated visual identity are trademarks of CareNest Health.

To the fullest extent permitted by law, CareNest and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. This includes, but is not limited to, personal injury, pain and suffering, emotional distress, or loss of data. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

CareNest provides its services on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure, though we employ robust safety measures.

You agree to indemnify, defend, and hold harmless CareNest, its affiliates, and their respective officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your violation of these Terms, your misuse of the Services, or your violation of any third-party rights.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. We adhere to HIPAA guidelines and maintain strict confidentiality of your health records. By using our Services, you acknowledge our privacy practices and consent to the use of your data as described in the Privacy Policy.

Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Boston, MA.
